Section 1 Basic Provisions and Provider Information

(1) The following terms and conditions apply to all contracts concluded with us as the seller:

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities. An entrepreneur is any natural or legal person or a partnership with legal capacity acting in the exercise of their independent professional or commercial activity when concluding a legal transaction.

Section 2 Conclusion of Contract

(1) The subject matter of the contract is the sale of handcrafted ceramic goods.

(2) The presentation of goods in our online shop does not constitute a legally binding offer, but an invitation to place an order (*invitatio ad offerendum*).

(3) By clicking the button that finalizes the order process (e.g., "Complete order", "Pay now", or "Buy now"), you submit a binding offer to purchase the goods in your shopping cart. When using an express checkout service (such as PayPal Express, Apple Pay, or Klarna), you will be redirected to the provider's payment page; the offer is submitted upon confirming the payment authorization.

(4) The contract is formally concluded when we accept your offer by sending an explicit order confirmation via email or by dispatching the goods. An automated acknowledgement of receipt does not constitute an acceptance of the offer.

(5) The processing of orders and transmission of all necessary details occurs partly via automated email systems. You must ensure that the email address provided to us is accurate and that the receipt of emails is technically secured and not prevented by SPAM filters.

Section 3 Prices, Taxes, and Shipping Costs

(1) All prices stated in the online shop are final prices in Euro and include the applicable statutory value-added tax (VAT).

(2) In addition to the stated product prices, shipping fees apply. These shipping costs are clearly indicated during the ordering process and on the dedicated "Shipping and Payment" page.

(3) Deliveries to countries outside the European Union may incur additional costs (such as customs duties, import turnover taxes, or cross-border payment handling fees) that are outside our control and must be borne by the customer. Any currency transfer or transaction fees (e.g., conversion fees charged by financial institutions) must also be borne by you if the delivery is made to an EU member state but the payment originates outside the European Union.

Section 4 Payment Terms, Right of Retention, and Retention of Title

(1) The payment methods displayed in the online shop or during the checkout process are available to you.

(2) You may only exercise a right of retention if your claim arises from the same contractual relationship.

(3) The delivered goods remain our property until full payment of the purchase price has been received.

Section 5 Delivery Terms and Studio Pick-up

(1) Delivery will be made to the delivery address specified by you. If you are a consumer, the statutory risk of accidental loss or damage during transit transfers to you only upon physical delivery of the goods.

(2) If you choose the "Studio Pick-up" option, no shipping costs will be charged. We will notify you via email as soon as your order is packaged and ready for collection at our Berlin atelier (Koburger Straße 15, 10825 Berlin).

Section 6 Right of Withdrawal

Consumers residing in the European Union are generally entitled to a statutory 14-day right of withdrawal. For detailed terms, conditions, exceptions, and the model cancellation form, please refer to our separate **Cancellation Policy** (Widerrufsbelehrung).

Section 7 Statutory Warranty and Handcrafted Ceramic Characteristics

(1) The statutory provisions governing warranty rights for product defects under German law apply.

(2) Artisanal and Handcrafted Character: All objects are individually produced by hand in our Berlin studio and are unique. Minor variations in dimensions, silhouette, glaze color nuances, flow marks, or subtle organic surface textures are natural results of the ceramic firing and making process. These characteristics underline the artisanal authenticity of each piece and do not constitute a defect.

(3) As a consumer, you are kindly requested to inspect the goods upon delivery for completeness, obvious defects, or transport damage, and to notify us and the shipping carrier as soon as possible. Any failure to do so will have no effect on your statutory warranty rights.

Section 8 Limitation of Liability

(1) We have unlimited liability for damages resulting from injury to life, body, or health, as well as for damages caused by intent or gross negligence.

(2) In cases of slight negligence, we are only liable for the breach of a cardinal contractual duty (an obligation whose fulfillment is essential to the proper execution of the contract and upon which the customer regularly relies). In such cases, liability is limited to typical and foreseeable contractual damages.

Section 9 Applicable Law and Place of Jurisdiction

(1) The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers having their habitual residence within the EU, this choice of law applies only insofar as mandatory consumer protection provisions of their country of residence are not deprived.

(2) If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is our place of business in Berlin, Germany.

Dispute Resolution:

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. The former European Online Dispute Resolution (ODR) platform has been discontinued.

2. Contract Language and Storage of Contract Text

(1) The language available for concluding the contract is English.

(2) The complete text of the contract is not stored by us. Before submitting the order via the online shopping cart system, the contract data can be printed out or saved electronically using your browser's print or save function. Upon receipt of your order, the order details and these Terms and Conditions will be sent to you again via email.

Showroom & Opening Hours

Is there a Molekūl Ceramics shop that I can visit in person?

We currently operate a studio with a showroom in Berlin-Schöneberg, where we craft all of our porcelain. We are happy to arrange appointments with customers and are always happy to open our doors if someone drops by to see or purchase our products.

However, we do not have fixed opening hours.

Of course, we offer customers residing in Berlin the option of free pickup for online purchases at our studio.

What are your opening hours?

We are opening our showroom by appointment. Even if you would like to come around to browse, please feel free to contact us via the contact form, by phone/WhatsApp, or by email at hello@molekul-ceramics.com.

We are generally in the studio in the mornings, and of course our doors are open during that time.

Is the porcelain from Molekūl Ceramics produced in Berlin, or is it imported from Portugal or other countries?

From idea and prototype to the finished product, every single piece is handcrafted in our studio in Berlin.

We source our materials from local suppliers - whenever possible from local manufacturers.

Consequently, there are no emissions from intra-European heavy-duty transport or ocean freight, and no additional packaging waste.

We love Berlin and are constantly inspired by this wonderful city.

Order

Can I have my order gift-wrapped?

Yes, we are happy to gift-wrap the items you ordered and can also include a personalized card upon request.

My order arrived damaged. What should I do?

We pack every product with great care and plenty of recyclable cushioning material. Should your order arrive damaged nonetheless, please contact us as soon as possible at hello@molekul-ceramics.com, including your order number and a photo. We will get back to you with a proposal on how to proceed in your individual case.

Should an item have a genuine defect, we will of course provide a replacement.

Please note: Since each of our ceramic pieces is handcrafted, fine nuances in shape, color depth, glaze flow, and wall thickness are signs of artisanal work and do not constitute a defect.

Can I exchange my order?

A direct exchange or item swap (e.g., a vase for a cup) is unfortunately not technically possible. However, you can cancel your order as usual within the statutory 14-day period, return the items to us, and simply place a new order for your desired item in the shop.

Products

Why can the items sometimes have variations in color, shape, or wall thickness?

Our items are not mass-produced factory goods. Each product is handmade by our small team in approximately 10-15 steps. We do not use large industrial machines and intentionally leave room for subtle variations in our processes: soft nuances in color depth, wall thickness, edge symmetry, or glaze application are not coincidental, but rather consciously created vitality.

This results in a harmonious, non-uniform, entirely organic look – that is our style. Every piece becomes a handmade unique item.

If I buy another piece from the same series, will it be identical to the previous one?

As every object is a handmade unique piece, slight variations in color intensity, edge symmetry, glaze application, or wall thickness may occur. The organic vitality, the breaking of conformity, is what gives our products their unique charm.

The product will be very similar, but will differ slightly from its product siblings.

Is your tableware suitable for food consumption and free of harmful substances?

Yes, our tableware is suitable for food consumption.

Each of our glazes has been tested for lead and cadmium release by M.U.T. – Meißner Umwelttechnik GmbH – and complies with the legal requirements, the provisions of the German Commodities Ordinance, Regulation (EC) No. 1935/2004, the European Directive 84/500/EEC including Directive 2005/31/EC, and Regulation 2023/2006 on good manufacturing practice, in their versions current at the time of issuance. The lead and cadmium leaching levels are below the legal limits.

Porcelain care and cleaning

Is the porcelain dishwasher safe?

Yes, our porcelain is very durable and dishwasher safe. We recommend cleaning it on a gentle cycle with a mild dishwashing detergent.

Be careful when loading and unloading the dishwasher and ensure that the porcelain does not knock together.

For particularly mindful and careful cleaning, we recommend a gentle hand wash.

How do I care for my porcelain?

Although our handmade porcelain is made for daily use, we recommend handling it with care.

Cleaning: Wash the dishes using the gentle cycle of your dishwasher or by hand with a mild dish soap.

Use soft towels for cleaning and drying, and avoid harsh abrasive cleaners or rough sponges.

Preventing scratches: Place linen or felt dish protectors between the porcelain pieces to prevent scratches in the glass-like surface of the glaze. These can become visible, especially on our darker porcelain colors.

Preventing cracking: Sudden, extreme temperature changes can cause thermal shock. This can lead to cracks in the porcelain or the glaze. Never pour boiling hot water into the porcelain vessels, never heat them on a stovetop, and never place them directly from the freezer into a preheated oven.
